1. Acceptance of Terms

By accessing and using the Cyrus Game Worlds website and games, you agree to be bound by these Terms of Service. If you do not agree to abide by the foregoing, please do not use this service.

4. Prohibited Conduct

You agree not to engage in any of the following prohibited behavior:

• Sharing explicit, offensive, or obscene content
• Using cheats, exploits, or unauthorized third-party software
• Attempting to access other users' accounts
• Spamming or excessive advertising
• Distributing malware or viruses
• Violating any applicable laws or regulations
• Engaging in fraudulent or deceptive practices

5. Intellectual Property Rights

All content, features, and functionality of our services are owned by Cyrus Game Worlds, its licensors, or other providers of such material and are protected by international copyright, trademark, and other intellectual property laws.

• You may not use our intellectual property without explicit written permission

6. User-Generated Content

If you submit, post, or display content on our services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content. By submitting content, you represent that:

• The content does not violate any third-party rights
• The content is not defamatory, illegal, or harmful
• You understand your content may be viewed by others

7. Limitation of Liability

To the maximum extent permitted by law, Cyrus Game Worlds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits arising from or related to your use of our services.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above limitations may not apply to you. In such cases, our liability is limited to the amount you paid for the service.

8. Account Suspension and Termination

We may suspend or terminate your account, or restrict your access to the Service, where reasonably necessary, including if you materially or repeatedly breach these Terms, engage in fraud or unlawful activity, or misuse the Service.

• Where permitted by applicable law, we may take such action immediately where circumstances reasonably require it. We will provide notice where reasonably practicable, taking into account the nature and severity of the circumstances.
• Upon suspension or termination, access to the Service and associated features may be disabled. Depending on the circumstances and applicable law, you may lose access to game progress, virtual items, and other account-related content.
• Termination or suspension does not affect any rights or remedies you may have under applicable law. Any refunds will be handled in accordance with applicable law and our applicable refund policy.
• You may lose access to game progress and purchases
• Refund policies will be honored according to applicable laws
• Nothing in these Terms limits any mandatory consumer rights or other rights that cannot lawfully be excluded or restricted.

9. Dispute Resolution

Any dispute arising from or relating to these Terms or our services shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles.

We will make reasonable efforts to understand and resolve your concern fairly and amicably. If we are unable to resolve a dispute informally, the applicable dispute-resolution procedure will depend on your country or jurisdiction of residence, as described below. Nothing in these Terms is intended to limit any mandatory consumer rights or protections that cannot lawfully be excluded or restricted under applicable law.
• 2. United States Of America : Please read this section carefully, as it may affect your legal rights, including your right to bring a claim in court or participate in a jury trial. To the extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, your use of our services, or the relationship between you and Cyrus Game Worlds, including disputes concerning their formation, interpretation, breach, termination, enforcement, or validity, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable Consumer Arbitration Rules. To the extent permitted by applicable law, you and Cyrus Game Worlds agree that claims may be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. Nothing in this section limits rights or remedies that cannot legally be waived under applicable law.
• 3. European Union (EU), Germany, Switzerland, Norway, Andorra, Lichtenstein, Luxemburg, Cyprus, Malta, Monaco & Holy See : If you are a consumer residing in the European Union or another jurisdiction in which mandatory consumer protection or dispute-resolution rules apply, those mandatory rules remain unaffected by these Terms. If you have a dispute concerning our services, please contact our support team first at support@cyrusgameworlds.com so that we can attempt to resolve the matter directly. The European Union's former Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. Consumers may instead use the applicable consumer alternative-dispute-resolution bodies available in their country, where applicable. For information about available consumer dispute-resolution bodies in EU Member States and participating countries, consumers may consult the European Commission's current consumer redress resources. German Residents : For consumers residing in Germany, the applicable provisions of the German Act on Alternative Dispute Resolution in Consumer Matters (Verbraucherstreitbeilegungsgesetz – VSBG) apply. Cyrus Game Worlds will state, as required by applicable law, whether it is willing or legally required to participate in a dispute-resolution procedure before a competent consumer conciliation body. Where a dispute cannot be resolved directly with the consumer, we will provide any further information concerning the competent consumer conciliation body and our willingness or obligat on to participate as required by applicable German law.
• 4. United Kingdom (UK), Canada, Australia, & New Zealand : If you are a consumer residing in the United Kingdom, Canada, Australia, or New Zealand, any dispute that cannot be resolved informally through our support team shall be handled in accordance with the mandatory laws and consumer-protection rules applicable in your jurisdiction of residence. Where permitted by applicable law, disputes may be brought before the ordinary courts having jurisdiction over the consumer or the dispute. Nothing in these Terms is intended to exclude or restrict statutory consumer rights that cannot lawfully be excluded or restricted, including rights under applicable consumer-protection legislation.
• 5. Japan, South Korea, Taiwan, Israel, & Singapore : If you are a consumer residing in Japan, South Korea, Taiwan, Israel, or Singapore, any dispute arising out of or relating to these Terms or our services that cannot be resolved informally shall be handled in accordance with the mandatory laws and consumer-protection rules applicable in your jurisdiction of residence. Where permitted by applicable law, disputes may be brought before the competent ordinary courts of your jurisdiction of residence. If both parties voluntarily agree after a dispute has arisen, they may also agree to mediation or arbitration through an appropriate dispute-resolution body under the applicable local rules.
• 6. Central and South American Countries : For consumers residing in Central or South American countries, including but not limited to Brazil, Argentina, Mexico, Colombia, and Chile, any dispute that cannot be resolved through our customer-support process shall be handled in accordance with the mandatory consumer-protection and dispute-resolution laws applicable in the consumer's jurisdiction of residence. Where required or permitted by applicable law, disputes may be brought before the competent courts or consumer-protection authorities of the applicable jurisdiction. Nothing in these Terms is intended to exclude or restrict mandatory consumer rights or protections.
• 7. Mandatory Local Rights : Regardless of the dispute-resolution provisions above, if the laws of your country or jurisdiction of residence grant you mandatory consumer rights, remedies, court-access rights, or dispute-resolution rights that cannot lawfully be waived, those rights remain unaffected. If any provision of this section is determined to be unenforceable in a particular jurisdiction, it shall be interpreted or modified to the minimum extent necessary to comply with applicable mandatory law, without affecting the remaining provisions to the extent permitted by law.

10. Warranty Disclaimer

To the extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. We do not guarantee that :

• the Services will be uninterrupted, secure, or error-free;
• the Services will meet your particular expectations or requirements; or
• all defects, bugs, glitches, issues or errors will be corrected.
• The performance of the Services may vary depending on your hardware, drivers, operating system, graphics settings, power configuration, cooling, and other system conditions. You are responsible for ensuring that your hardware and system configuration are suitable for running the Services and comply with the applicable specifications and recommendations of the relevant hardware manufacturers.
• In particular, certain graphics settings or system configurations may result in increased GPU power consumption, heat generation, or electrical load. You should follow the safety, power, cabling, installation, and operating instructions provided by your graphics-card, power-supply, and other hardware manufacturers.
• We do not represent or warrant that every combination of hardware, power supply, cabling, firmware, drivers, or system configuration will be compatible with or suitable for the Services.
• Nothing in these Terms excludes or limits any warranty, statutory consumer right, or liability that cannot legally be excluded or limited under applicable law. In particular, nothing in these Terms excludes liability for damage caused by our intentional or grossly negligent conduct or otherwise limits mandatory statutory rights and remedies.

11. Entire Agreement

These Terms of Service, along with our Privacy Policy and any other policies we post, constitute the entire agreement between you and Cyrus Game Worlds regarding your use of our services.
